Terms & Conditions of Ticket Purchase, Entry, Liability, and Activity Participation

THESE TERMS AND CONDITIONS CONTAIN IMPORTANT INFORMATION ABOUT YOUR LEGAL RIGHTS, INCLUDING YOUR WAIVER OF LIABILITY, YOUR ASSUMPTION OF RISK RELATED TO EXPOSURE TO COVID-19 OR ANY OTHER COMMUNICABLE DISEASE, YOUR WAIVER OF CLASS ACTION RIGHTS, AND YOUR AGREEMENT TO BINDING ARBITRATION.
BY PURCHASING A TICKET, ENTERING THE PREMISES, OR PARTICIPATING IN ANY ACTIVITY, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREED TO ALL TERMS BELOW.
I. Ticket Policy and Admission
- All Sales Final:
All tickets, packages, and add-ons are non-refundable. No refunds, exchanges, credits, or reimbursements will be issued for any reason, including but not limited to illness, weather, travel delays, personal scheduling conflicts, dissatisfaction with the event, or an inability to attend. - One-Time Ticket Change Policy:
Guests may change their ticket one (1) time only to a different available date or time through our authorized third-party ticketing system.
- If the new slot is higher in price, guests must pay the difference.
- If the new slot is lower in price, no refund, credit, or reimbursement will be issued.
- After one change has been made, the ticket becomes fully locked and cannot be changed, modified, refunded, or exchanged for any reason.
- Admission Requirements:
- Each ticket admits one (1) person unless otherwise specified.
- A valid, government-issued photo ID may be required at check-in.
- Entry may be denied at the discretion of the Organizer for any reason, including but not limited to intoxication, disorderly conduct, or violation of venue rules.
- Re-entry is not permitted.
- Age Policy:
Jack Frost Christmas Pop Up is all ages at all times.
No refunds will be issued if a parent or guardian fails to supervise minors or if a guest fails to comply with onsite safety requirements.
II. Assumption of Risk and Waiver of Liability (Including COVID-19 and Other Infectious Diseases)
- Assumption of Risk:
By attending the event or participating in any onsite activity, you acknowledge the inherent risk of exposure to COVID-19, SARS-CoV-2, and other communicable or infectious diseases. These risks include but are not limited to illness, injury, or death. You understand these risks cannot be fully eliminated despite the Organizer’s safety efforts, and you voluntarily assume all risks associated with attendance and participation. - Waiver and Release:
You, on behalf of yourself and your heirs, executors, administrators, and assigns, hereby waive, release, and discharge Fulton Market Pickle and Holiday Events LLC, Jack Frost Christmas Pop Up, and all officers, owners, directors, employees, agents, contractors, affiliates, insurers, and successors (“Released Parties”) from any and all claims, liabilities, damages, or losses arising out of or relating to exposure to any communicable or infectious disease during or after your attendance.
This waiver includes claims based on ordinary negligence to the fullest extent permitted by law. - Tickets Purchased for Others:
If you purchase or transfer tickets to others, you represent and agree that all recipients have independently reviewed and accepted these Terms, including this waiver and assumption of risk. - Indemnification:
You agree to indemnify and hold harmless the Released Parties from any claims, damages, losses, or expenses (including attorneys’ fees) brought by any third party arising from or related to your attendance, conduct, or violation of these Terms.
III. Health and Safety Acknowledgment
Guests must comply with all venue rules, posted instructions, safety briefings, and any health guidelines required by the City of Chicago or the State of Illinois.
The Organizer reserves the right to refuse entry or remove any guest who fails to comply, without refund.
IV. Conduct and Removal
Guests must behave in a safe, respectful, and responsible manner. The Organizer may remove or refuse entry to anyone for reasons including but not limited to:
- Intoxication or drug use
- Harassment, discrimination, or disruptive behavior
- Violence or threats
- Property damage
- Failure to comply with staff instructions
- Violation of any venue rule or law
Removed guests will not receive refunds or credits.
V. Activity Participation Terms (Ice Skating, Axe Throwing, Winter Bumper Cars, Galaxy Revolution)
By participating in any activity at Jack Frost Christmas Pop Up, you acknowledge and accept the additional risks described below.
1. Ice Skating
Ice skating involves inherent risks including slips, trips, falls, equipment malfunction, cold exposure, and collisions with other participants or rink structures. You understand that ice skating blades are sharp and may cause serious injury. You voluntarily accept all risks associated with skating or entering the skating area.
2. Axe Throwing
Axe throwing involves handling and throwing sharp axes in close proximity to others. Risks include, but are not limited to: improper technique, bouncing axes, equipment malfunction, misthrows, and unexpected actions by nearby participants. You willingly accept all risks and agree to follow all instructions from staff.
3. Winter Bumper Cars
Participation includes the risk of sudden movement, rapid acceleration or deceleration, mechanical malfunction, collision impacts, and potential injury from incorrect seating or failure to follow instructions. You accept all risks associated with riding or entering the bumper car area.
4. Galaxy Revolution Ride/Attraction
Galaxy Revolution includes fast movement, spinning, motion effects, lighting effects, and sensory stimulation. Risks include dizziness, nausea, motion sickness, falls while boarding or exiting, and potential aggravation of preexisting conditions. You voluntarily accept all risks associated with participation.
5. General Activity Waiver
By participating in any activity, you:
- Assume all risks, both known and unknown.
- Release and discharge the Released Parties from all liability related to participation.
- Agree that minors may only participate under supervision of a responsible adult who accepts these Terms on their behalf.
- Understand that refusal to follow safety instructions may result in removal without refund.
VI. Limitation of Liability
To the fullest extent permitted by law, the Released Parties shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages arising from attendance at the event or participation in any onsite activity, even if advised of the possibility of such damages.
VII. Binding Arbitration and Class Action Waiver
- Agreement to Arbitrate:
Any dispute, claim, or controversy arising out of or relating to these Terms, your ticket purchase, your attendance, or your participation in any activity shall be resolved exclusively by binding arbitration under the rules of the American Arbitration Association (AAA). Judgment on the arbitration award may be entered in any court with proper jurisdiction. Both parties waive the right to a trial by jury. - Class Action Waiver:
You agree that any claim must be brought individually, not as a class, collective, or representative action. No arbitration may be combined with another without written consent from all parties. - Location and Governing Law:
Unless prohibited by law, arbitration shall take place in Cook County, Illinois and be governed by the laws of the State of Illinois and the Federal Arbitration Act. - Informal Resolution Process:
Before initiating arbitration, the complaining party must send a written notice describing the dispute and requested resolution to:

Both parties agree to attempt informal resolution for sixty (60) days before commencing arbitration.
VIII. Governing Law and Venue
These Terms are governed by the laws of the State of Illinois and the City of Chicago. If arbitration is not pursued, disputes shall be brought exclusively in the courts of Cook County, Illinois.
IX. Severability
If any part of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
X. Entire Agreement
These Terms constitute the complete and final agreement between you and Fulton Market Pickle and Holiday Events LLC regarding ticket purchase, venue entry, and activity participation, superseding all prior agreements or representations.
XI. Acknowledgment
By completing your ticket purchase or entering the venue, you acknowledge that you have read, understood, and agreed to all Terms and Conditions outlined above, including the waiver of liability, assumption of risk, arbitration agreement, and class action waiver.
